1. Who Operates This Platform

Tanga Tanga Club (the "Platform") is a product owned and operated by Kejani Garage Limited, a company registered in Kenya since 2023 ("Kejani Garage", "we", "us", or "our"). References to "Tanga Tanga Club" throughout these Terms refer to the Platform as operated by Kejani Garage Limited.

2. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of the updated Terms.

3. Eligibility

You must be at least 18 years old to use our services. By using our Platform, you represent and warrant that you are of legal age and have the capacity to enter into a binding agreement. Accounts created by minors are prohibited and will be terminated.

4. Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized use of your account.

5. Bookings and Payments

All bookings made through our Platform are subject to availability and confirmation. Payment is processed securely through Paystack. By booking an event or experience, you agree to pay all applicable fees. Prices are displayed in Kenyan Shillings (KES).

Listings on the Platform may be offered directly by Tanga Tanga Club, or by independent, admin-verified Hosts or Affiliates using our marketplace features (see Section 6). The listing page for each event or experience indicates who is offering it.

Refund Policy: Cancellations made at least 7 days before the experience start date are eligible for a full refund minus a 10% administrative fee. Cancellations within 7 days of the experience are non-refundable. No-shows forfeit the entire booking amount. This default policy applies unless a specific listing states otherwise.

Price Changes: Prices are subject to change without notice. However, confirmed bookings are guaranteed at the price paid at the time of booking.

6. Selling on the Platform (Hosts & Affiliates)

Verified members may apply to become a Host (to list and sell their own events or experiences) or an Affiliate (to resell Tanga Tanga Club listings to their own network). Every application is reviewed and must be approved by our admin team before it becomes active — approval is not automatic and may be declined or later suspended at our discretion.

Commission: Each approved Host or Affiliate is assigned a commission rate by our admin team, which is disclosed to them before their listings go live and may be updated from time to time. For Hosts, payments for their listings are processed via Paystack and automatically split at the moment of payment: our commission is retained by the Platform, and the remainder is settled directly to the Host's own linked bank account through their Paystack Subaccount. Hosts are responsible for the accuracy of the bank details they provide.

Host responsibility: For listings created by a Host, the Host — not Tanga Tanga Club — is the party responsible for accurately describing, delivering, and honoring that listing. Tanga Tanga Club acts as a marketplace facilitator that verifies Hosts, processes payment, and provides the booking infrastructure; it is not the organizer of Host-created listings and is not a party to the underlying arrangement between a Host and a customer, except as expressly set out in these Terms.

We may reject, suspend, or remove any Host, Affiliate, or listing at our discretion, including for inaccurate information, customer complaints, or violations of these Terms.

7. Community Features & User-Generated Content

The Platform includes community features — chat channels, comments, interest groups ("sub-communities"), content sharing, and game activity — that let members interact with one another. Your use of these features is also governed by our Community Guidelines, which are incorporated into these Terms by reference.

By posting, sharing, or otherwise submitting content through these features ("User Content"), you retain ownership of it, but you grant Tanga Tanga Club a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that User Content on and through the Platform for as long as it remains posted.

You agree not to post external links in chat, comments, or group posts (use the in-app Share feature to share an event, experience, blog, or game instead), and not to post spam, harassment, hate speech, impersonation, or content that violates the Community Guidelines or any other part of these Terms.

Interest groups: Any member may propose a new interest group, which must be approved by our admin team before it is visible to other members. Approved groups may set additional rules for their own space, on top of these Terms and the Community Guidelines, which always apply.

Moderation: We may remove any User Content, and may restrict an account from posting (temporarily or permanently) for violating these Terms or the Community Guidelines, at our discretion and without prior notice.

8. User Conduct

You agree not to:

• Use the Platform for any illegal or unauthorized purpose.
• Harass, abuse, or harm other users or our staff.
• Post false, misleading, or fraudulent content.
• Attempt to gain unauthorized access to our systems.
• Use automated means to access or scrape the Platform.
• Interfere with or disrupt the integrity or performance of the Platform.

9. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of Tanga Tanga Club, Kejani Garage Limited, or its licensors (excluding User Content, addressed in Section 7) and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or exploit any such content without our express written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Tanga Tanga Club and Kejani Garage Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform. For Platform-offered listings, our total liability shall not exceed the amount paid by you for the specific experience in question. For listings created by an independent Host, our liability is further limited as described in Section 6, given our role as a marketplace facilitator rather than the listing organizer.

11. Indemnification

You agree to indemnify and hold harmless Tanga Tanga Club, Kejani Garage Limited, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Third-Party Links and Services

Our Platform may contain links to third-party websites or services, and relies on third-party providers such as Paystack for payments. We are not responsible for the content, policies, or practices of third parties. Your interactions with third parties are solely between you and the third party.

13. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Where the concern is limited to community features, we may instead apply a lesser restriction, such as removing content or restricting your ability to post, as described in Section 7.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Nairobi, Kenya.

15. Changes to Terms

We reserve the right to revise these Terms at any time. We will provide notice of changes by updating the "Last updated" date at the top of this page. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
